The term Driving Tour as used in these terms and conditions refers to the driving tours, related cultural activities, accommodation, meals and any other activities as described in the related event overview and itinerary and any other activities and actions which occur during the event.
Eligibility & Reservations
In order to participate you must be aged 21 or over at the time the Driving Tour takes place. Upon completion of the booking form you can either use the PayPal button on the page to pay by credit/debit card or PayPal account or you can pay by cheque or bank transfer. A deposit of 30% of the total value will be requested for the booking, and your reservation will be confirmed when the payment is made.
The remaining balance must be paid no later than 14 weeks before the start of the Driving Tour. In case this date has passed, then full payment at the time of registration will be requested.
In case full payment has not been received within 14 weeks of the start of the Driving Tour, we reserve the right to cancel the booking, subject to the cancellation conditions described below.
To complete the reservation form, it is necessary to accept these terms and conditions and a completed reservation is considered an acceptance thereof.
Methods of Payment
You may pay by cheque, credit or debit card via Paypal or electronic transfer directly to our bank account. Please allow enough time for payment to clear by the due date.
Cancellation by the Customer
If you wish to cancel your booking for a Driving Tour you must notify us in writing as soon as possible. Cancellation costs are as follows:
More than 99 days before start date – loss of deposit *
Between 98 and 29 days - 70% of the total cost of the holiday **
Between 28 and 14 days - 90% of the total cost of the holiday **
Less than 14 days – 100% of the total cost of the holiday - no refund possible
* If the customer cancels more than 98 days before the start date and a replacement is found (either by the customer or the participating car club if appropriate) then the deposit may, at the discretion of the Directors of European Driving Tours Ltd, be refunded. In all cases this will incur a £100 administration charge.
** If tour books have already been issued to the customer then there will be no refund possible (see below).
If the final balance of the holiday is not paid when requested (usually, but not exclusively, 14 weeks prior to travel), then the customer will be deemed to have cancelled and any deposit paid will be lost.
Cancellation by European Driving Tours Ltd
Whilst we shall at all times use best efforts to avoid cancellation, we reserve the right to cancel your holiday in case of circumstances beyond our control. The minimum number of vehicles required in order for a tour to take place is four.
If an alternative equivalent Driving Tour is available we will offer you this option (or allow you to use your payment for another Driving Tour). However, you retain the right to a full refund should you decide not to accept the offer of an alternative Driving Tour, or if an alternative Driving Tour is not available.
We reserve the right to prohibit your participation at any stage if we become aware of any illegal, inappropriate, unsafe or antisocial behaviour. In this case we reserve the right not to provide a refund and we will not be held responsible for any additional costs you incur as a result of your termination.
Tour Books (including routes and hotels)
Tour Books and detailed route & hotel information will only be issued once full payment for the Tour has been made. Once Tour Books and detailed route and hotel information has been issued, no refund will be made due to cancellation by the customer. This condition supercedes all conditions in the "Cancellation by Customer" section above. The terms shown in the "Cancellation by European Driving Tours" section above remain unaltered by the timing of issue of the Road Book. Additional or duplicate Tour Books can be requested, the cost for these is £45 per book.
All prices include channel tunnel or ferry tickets (as specified in the tour details), bed and breakfast accommodation, drivers pack (including detailed driving routes, list of accommodation addresses, contact names & phone numbers, sat nav coordinates or addresses, and European driving checklist), services of 2 European Driving Tour staff, and a lead car (on escorted Tours).
Not included: Spending money, fuel and toll charges, other accommodation and meals outside those specifically included in the Driving Tour package, & personal acquisitions. Breakdown costs, car insurance, travel or personal insurance and any fines incurred are also not included.
Requests for Changes to a Driving Event
Upon request, we will endeavour to make any minor amendments to your booking. Any requests for amendments must be made to us as soon as possible. If after booking, room details or any similar changes are requested by the customer (i.e. twin room to single room) then an administration fee of £25 per hotel affected will be charged. This fee will be in addition to any refund or charges levied by the hotel pertaining to the change of room.
Changes to your Eurotunnel booking (e.g. Car registration number) can be made free of charge up to your final payment is made. An administration fee of £25 will be charged each time an amendment is requested following final payment.
If we feel the changes are significant, or if they affect the feasibility of the tour, we reserve the right to treat the amendment as a cancellation of the booking in line with the terms and conditions set out under “cancellation” above.
Changes made by European Driving Tours Ltd
Although very unlikely, changes to a Driving Tour may occasionally be unavoidable for reasons beyond our control (e.g. road or hotel closures). Where changes to a Driving Tour are unavoidable we will notify you as soon as practicable and provide alternative options.
Unfortunately, it is the nature of road travel that prearranged journeys may be delayed for reasons out of our control. In the event of any travel delays both before and during the Driving Tour, whether foreseen or not, European Driving Tours Ltd can in no way be deemed to be responsible for the delays and therefore we will not be liable for any extra costs you may incur. Examples of such costs include, but are not limited to, hotels, ferry crossings, hire cars, meals and drinks, adverse weather conditions, natural disasters, technical difficulties or industrial disputes. If for whatever reason you are unable to complete the Driving Tour you will in no circumstances be entitled to any refund for any unused services booked on your behalf. These conditions apply regardless of the how the delays were incurred and apply to both escorted and unescorted Tours.
Foreign Office Advice
Prior to travel you should always refer to the Foreign Office Travel Information and observe any recommendations regarding the countries that you will be visiting on your Tour.
Passports and Visas
You are responsible for arranging, and must be in possession of, a valid passport and any visas required for the whole of your journey.
It is your responsibility to ensure you have the appropriate travel insurance in place for yourself, your passengers, personal effects, luggage & the vehicle itself.
In the event of cancellation of the holiday by the customer at any stage, pre-paid excursions and tours will be treated in the same manner as deposits and be non-refundable. In the event of cancellation by EDT Ltd monies will be refunded to a value not exceeding that paid for the tour or excursion.
In the event of cancellation of the holiday at any stage by the customer, pre-paid meals may be refunded if the hotel providing the meal waives any charges. In the event that the hotel does not waive the charges any pre-paid meals will not be refunded. In the event of cancellation by EDT Ltd, monies will be refunded to a value not exceeding that paid for the meals.
Except where expressly stated within these terms and conditions, we regret we cannot accept liability or pay any compensation where the prompt performance of our contractual obligations is affected or prevented by “force majeure”.
Force Majeure refers to any event which we or our suppliers could not, even with all due care, foresee or avoid. Such events may include, but are not limited to, war or threat of war, riot, civil strife, terrorist activity or actual threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire.
Legal Compliance & Personal Responsibility
In accepting these terms and conditions you are accepting your responsibility to ensure you abide by all statutory laws and regulations of each of the countries travelled through. These include, without limitation, to your regard to speed limits, the legality and safety of your vehicle (e.g. tax, insurance, MOT) and not driving under the influence of any intoxicating substances. You must hold a full valid driving license and passport if applicable.
You are in no way allowed to compete or race with other guests. You are entirely responsible for your own behaviour and you expressly hold harmless European Driving Tours Ltd if you undertake in any illegal, unsafe or antisocial behaviour, and you will indemnify European Driving Tours in full against any attempt by third parties to bring about any claim as a result of any breach by you of any laws or regulations, including these terms and conditions, or any illegal, unsafe or antisocial behaviour during your participation in a Driving Tour.
Should any participants be prevented from continuing a Tour due to, but not exclusively limited to, loss of licence, imprisonment, impounding of vehicle etc., then that individual shall be responsible for repatriation of themselves and their vehicle and will not be eligible for any refund.
Similarly, should individuals fail to arrive at the allocated hotel for any reason European Driving Tours shall not be responsible for any charges incurred for alternative accommodation.
Where Tours are booked by a group organiser (i.e. car clubs) and European Driving Tours has no direct relationship to the individuals attending that tour, then the organiser of that group shall be deemed to have accepted all of these terms and conditions and be responsible for all actions of individuals in that group. Specifically, where European Driving Tours has booked channel crossings and accommodation only for a car club or group booking, then that car club or group organiser shall take full responsibility for outstanding hotel charges incurred by their group for meals, bar bills, mini bars, damage etc. Failure of the group organiser to settle any such outstanding costs shall result in the cancellation of the remainder of the Tour without refund.
European Driving Tours will endeavour to make sure that all parts of your Driving Tour that we have agreed to arrange, perform or provide as part of our contract with you, are done so with reasonable skill and care. In relation to the supply of goods and services, we will not be liable to you or a member of your party, except where expressly stated within these terms and conditions, for any injuries, liabilities, damages or other losses incurred by you or your property. Unless stated otherwise in these terms and conditions, our total liability to anyone lodging a claim in relation to our negligent act shall not exceed the cost incurred by that person. In any event the maximum liability of European Driving Tours shall be limited to 50% of the cost of a single Driving Event for one person.
Third party liability
Those parts of the Driving Tour and any detours taken by the customer which involve utilising the services of third parties (e.g. hotels, rail travel, ski lifts & ferry crossings) will be governed by the terms and conditions of each individual third party.
You and the members of your party are responsible for all add on costs as described elsewhere within these terms and conditions, in addition to items such as fines, penalties, damages and other expenses incurred by you during the Driving Tour. If we are in anyway held accountable for such items, you will indemnify us and promptly repay any amounts we pay on your behalf. Participation in a Driving Tour is voluntary and in the full knowledge that any accident, injury or other incident to you or third parties as a result of your actions is entirely your responsibility and liability and you therefore indemnify European Driving Tours Ltd and its directors and officers in full against any claim brought about by you, a member of your party or a third party.
European Driving Tours will create a "crew list" for all group Tours. This list will have names, car details and a contact phone number for each car and will be shared with the group in case of emergencies. By booking a group Tour you are deemed to have given your consent for this data to be shared within the group.
Similarly, European Driving Tours will also create "group emails" for all group Tours. We will correspond with the whole group via email prior to the Tour. Again, by booking a group Tour you are deemed to have given your consent to having your email address shared with the group.
In both cases above, should you not wish your data to be shared amongst the group you are travelling with, you must notify us in writing at the time of booking.
If you feel there is justification for complaint either before or during the Driving Tour you must notify one of our representatives immediately in order that we can attend to your complaint as effectively as possible. If upon returning home you are not satisfied with how your grievance has been attended to please inform us in writing within one week of the last day of the event.
Acceptance of Terms & Conditions
In booking a Driving Tour whether as an individual traveller or a group organiser, you are deemed to have read and fully understood these terms and conditions, and agree to be bound by them in their entirety. If upon reading these terms and conditions you do not understand any part of them, you must contact us at time of registration and before any payment is made.
